In these terms, “Aesthetic Pin”, “we”, “us” and “our” refer to AESTHETIC PIN LTD. “You” and “your” refer to anyone who visits the website, creates an account, applies for membership, submits a listing, uploads content, makes a payment or uses our services.
2. About Aesthetic Pin
Aesthetic Pin operates as a membership organisation, practitioner directory and verification-style platform for aesthetics practitioners, clinics and training or provider-related listings.
Our website may allow practitioners, clinics, training providers or related businesses to create accounts, apply for membership, submit profile information, upload supporting documents, request listing approval and display approved public or member-visible information.
Aesthetic Pin is not a medical regulator, statutory licensing authority, professional body, insurer, healthcare provider or emergency service. Any information displayed on the website is provided for general directory, membership, profile and platform purposes only.
3. Using this website
You may use this website only for lawful purposes and in accordance with these terms.
You agree not to use the website in any way that:
- breaks any applicable law or regulation;
- is fraudulent, misleading, harmful, abusive, defamatory or unlawful;
- infringes the rights of another person or organisation;
- interferes with the operation, security or availability of the website;
- attempts to gain unauthorised access to accounts, data, systems or services;
- introduces viruses, malware, malicious code or harmful material;
- scrapes, copies, harvests or extracts data from the website without permission;
- uses the website to send spam or unsolicited communications;
- impersonates another person, practitioner, clinic, business or organisation;
- submits false, incomplete, inaccurate or misleading information;
- promotes, advertises, lists, facilitates or encourages unlawful, illegal, unsafe, prohibited or improperly authorised treatments, services, products, procedures or practices.
We may suspend, restrict or terminate access to the website or any account if we believe these terms have been breached or if we need to protect the website, our users, our business or the integrity of the platform.
4. Accounts and registration
Some parts of the website may require you to create an account or provide registration information. You agree that any information you provide will be accurate, complete and kept up to date.
You must be at least 18 years old to create an account, apply for membership, submit a listing or use member-only features on the Aesthetic Pin website. By creating an account or applying for membership, you confirm that you are 18 or over.
You are responsible for keeping your login details secure. You must not share your password or allow another person to access your account unless we have expressly permitted this.
Accounts, memberships, listings, profile access and verification-style statuses are personal to the individual practitioner, clinic, business or organisation approved by Aesthetic Pin. They must not be sold, transferred, shared, assigned, loaned or passed to another practitioner, clinic, business, employee, contractor or third party without our prior written consent.
You must tell us promptly if you believe your account has been accessed without permission or if your login details may have been compromised.
We may refuse registration, suspend an account, restrict access or remove an account where we reasonably believe this is necessary to protect the website, users, applicants, members, the public, our business or the integrity of the platform.
5. Membership applications and member responsibilities
If you apply for membership with Aesthetic Pin, you agree to provide information that is accurate, complete, current and not misleading to the best of your knowledge.
As part of the membership application process, we may ask you to provide information about your identity, business or clinic, professional background, qualifications, CPD, insurance, first aid or BLS training, local authority registration or licensing, treatment categories, prescribing arrangements and any other information we reasonably consider relevant to your application.
We may also ask you to upload supporting documents, such as qualification certificates, training certificates, insurance documents, first aid or BLS evidence, local authority documents, policies, blank forms or other evidence connected with your application, membership, profile or listing.
You are responsible for making sure that the information and documents you provide are accurate, lawful, complete, up to date and not misleading. We are entitled to rely on the information and documents you submit when assessing your application, managing your membership, displaying your profile or applying any membership status, listing status or verification-style marker.
Submitting an application does not guarantee acceptance, approval, membership, verification, listing publication or continued access to the platform. We may approve, reject, request further information, pause, suspend or withdraw an application or membership where we reasonably consider it necessary to do so.
If your membership is approved, you must, to the best of your ability, keep your account information, profile information, qualifications, training records, insurance documents, local authority registration or licence details, first aid or BLS evidence, treatment categories and any other relevant supporting documents up to date.
You must update your information as soon as reasonably possible if anything changes that may affect your membership, listing, verification-style status, public profile, insurance position, treatment categories, business details, professional standing or ability to provide services lawfully and safely.
This includes updating or replacing documents that expire, are withdrawn, are superseded, become inaccurate, or no longer reflect your current position.
You must only advertise, list, offer, promote or carry out treatments, services or procedures that you are appropriately trained, competent, insured and, where required, licensed, registered or otherwise authorised to perform. You are responsible for ensuring that any treatments or services you list or promote fall within your professional scope of practice and comply with all applicable laws, regulations, professional standards, insurance requirements and local authority requirements.
You must not use Aesthetic Pin to promote, advertise, list, facilitate or normalise any unlawful, illegal, unsafe, prohibited or improperly authorised treatment, product, procedure, practice or service. We may refuse, remove, hide, suspend or restrict any content, profile, listing, membership or verification-style status where we reasonably believe it relates to unlawful, unsafe, misleading, inappropriate or improperly authorised practice.
If we become aware that your information or documents may be out of date, incomplete, inaccurate, misleading or missing, we may ask you to provide updated evidence. We may also temporarily hide, suspend, restrict or remove your profile, listing, verification-style status or membership access while the issue is reviewed.
Aesthetic Pin is not responsible for reminding every member when documents, insurance, qualifications, licences, registrations or training evidence expire. We may provide reminders or prompts from time to time, but responsibility for maintaining accurate and current information remains with you.
6. Listings and profiles
The website may allow approved users, members, practitioners, clinics, providers or businesses to submit information for a public or member-visible listing or profile.
Listing information may include your name, business or clinic name, location, treatment categories, services offered, practice setting, profile description, website links, social media links, membership status, verification-style status or other information approved for display.
You are responsible for making sure that any listing or profile information you submit is accurate, lawful, complete, up to date and appropriate for publication.
We may review, edit, reject, suspend, unpublish or remove any listing or profile content where we reasonably believe this is necessary, including where content is inaccurate, incomplete, misleading, unlawful, inappropriate, out of date, harmful to the integrity of the platform, or in breach of these terms.
We do not guarantee that any listing will be accepted, published, indexed by search engines, displayed in a particular order, generate enquiries, generate business or remain available at all times.
7. Verification-style checks and displayed status
Aesthetic Pin may operate verification-style checks or application review processes based on the information and evidence submitted by applicants, members, practitioners, clinics or providers.
Any displayed status, badge, profile marker, membership category or verification-style indication is based on the information available to us at the time of review and the criteria we choose to apply.
A displayed status does not mean that Aesthetic Pin guarantees the safety, competence, suitability, legality, clinical ability, professional conduct, financial standing, insurance validity, regulatory compliance or ongoing eligibility of any practitioner, clinic, provider, treatment or service.
Users of the website should make their own checks and enquiries before choosing a practitioner, clinic, provider, treatment or service.
Practitioners, clinics and providers are responsible for maintaining any qualifications, training, insurance, licences, registrations, permissions, consents, prescribing arrangements and legal requirements that apply to their own work.
8. Professional conduct, advertising and treatment claims
Practitioners, clinics, providers and members are responsible for ensuring that their professional conduct, advertising, public claims, profile content, before and after images, treatment descriptions, social media content, website links and promotional material comply with applicable law, professional standards, advertising rules and regulatory expectations.
This includes, where relevant, compliance with UK advertising guidance, the UK Code of Non-broadcast Advertising and Direct & Promotional Marketing, Advertising Standards Authority guidance, Medicines and Healthcare products Regulatory Agency requirements, data protection law, image consent requirements, platform rules and any rules that apply to prescription-only medicines, medical devices, regulated products, treatment claims or clinical claims.
You must not submit, upload, publish, link to or promote content that is false, exaggerated, misleading, irresponsible, unsupported, unlawful or likely to give users an inaccurate impression of your qualifications, experience, treatment outcomes, product use, clinical ability, insurance position, regulatory status or professional standing.
Before and after images must only be used where you have the right and appropriate consent to use them, and they must not be edited, selected, presented or described in a way that is misleading or likely to create unrealistic expectations.
Aesthetic Pin may remove, restrict, hide, suspend or reject content, listings, profiles or membership features where we reasonably believe advertising, treatment claims, images, social media links or promotional content may breach these terms, applicable law, advertising guidance, regulatory requirements, professional expectations or the integrity of the platform.
9. Uploaded documents and user content
You may be able to upload documents, images, forms, certificates, evidence, profile text, business information or other content to the website.
You must only upload content that you have the right to upload and share. You must not upload content that is unlawful, false, misleading, confidential without permission, defamatory, offensive, harmful, infringing, malicious or in breach of another person’s rights.
You are responsible for checking documents before uploading them. You should remove or redact personal data, sensitive information or third-party information that is not necessary for the purpose of the upload.
By uploading or submitting content, you confirm that:
- the content is accurate to the best of your knowledge;
- you have the right to submit it;
- it does not infringe anyone else’s rights;
- it does not breach any legal, professional, contractual or confidentiality obligation;
- we may use it for the purpose for which it was submitted.
We may remove, restrict or delete uploaded content where we reasonably believe it is inappropriate, unnecessary, unlawful, inaccurate, harmful, excessive, out of date or in breach of these terms.
9.1 Member content and user-generated content
Parts of the Aesthetic Pin website may allow members or users to create, upload, submit, publish or share content. This may include profile information, profile images, cover images, directory listing information, activity updates, comments, messages, group content, documents, images, links, business information or other material submitted through website features such as member profiles, directory tools, forms or community areas.
Any content you submit, upload, post, publish or share through Aesthetic Pin must be accurate, lawful, respectful, appropriate and not misleading.
You must not submit, upload, post, publish or share content that:
- is false, inaccurate, misleading or deceptive;
- is abusive, threatening, harassing, discriminatory, defamatory, obscene or offensive;
- infringes another person’s copyright, trade mark, privacy, confidentiality, data protection rights or other legal rights;
- contains personal data about another person without a lawful basis or appropriate permission;
- contains confidential information that you are not authorised to share;
- contains spam, advertising, scams, malware, harmful links or malicious code;
- makes false, exaggerated or unsupported claims about qualifications, experience, treatments, results, insurance, professional status or regulatory position;
- encourages unsafe, unlawful or irresponsible practice;
- promotes, advertises, lists or encourages unlawful, illegal, unsafe, prohibited or improperly authorised treatments, services, products, medicines, devices or practices;
- includes before and after images, treatment claims, advertising claims or social media content that is misleading, unsupported, non-compliant, improperly consented to, or likely to create unrealistic expectations;
- advertises or promotes treatments, services or procedures that you are not appropriately trained, competent, insured, licensed, registered or authorised to perform;
- damages, or is likely to damage, the reputation, safety, trustworthiness or integrity of Aesthetic Pin or its community.
You are responsible for any content you submit, upload, post, publish or share through the website. You confirm that you have the right to use and share that content and that doing so does not breach any law, professional obligation, confidentiality duty, advertising rule, platform rule or third-party right.
We may review, moderate, edit, hide, restrict, remove or delete member content or user-generated content where we reasonably believe it breaches these terms, our Community Standards, our policies, applicable law, professional expectations, advertising rules, or the intended purpose of the Aesthetic Pin platform.
We are not required to monitor all member content or user-generated content before it appears on the website, but we may take action where content is reported to us, identified by us, or reasonably considered inappropriate, unlawful, misleading, harmful or inconsistent with the purpose of the platform.
By submitting, uploading, posting, publishing or sharing content through Aesthetic Pin, you grant us a non-exclusive, worldwide, royalty-free licence to use, store, copy, display, publish, edit, format, moderate and process that content as necessary to operate the website, provide member features, display profiles or listings, manage the community, protect the platform and comply with our legal obligations.
10. Accuracy of information
We aim to keep information on the website accurate and up to date, but we do not guarantee that all website content, listings, profiles, member information, practitioner information, clinic information, service descriptions or other material will always be complete, accurate, current or free from errors.
Much of the information on listings and profiles may be provided by users, applicants, members, practitioners, clinics or third parties. We are not responsible for errors, omissions, outdated information or misleading statements provided by third parties.
If you notice information on the website that you believe is inaccurate, misleading or inappropriate, please contact us at info@aestheticpin.co.uk.
11. No medical, clinical or professional advice
The information on this website is provided for general information, directory, membership and platform purposes only. It is not medical, clinical, legal, regulatory, insurance, financial or professional advice.
You should not rely on website content as a substitute for professional advice, clinical assessment, medical treatment, legal advice, insurance advice or regulatory guidance.
If you are considering an aesthetic treatment, you should make your own enquiries, check the suitability of the practitioner or clinic, ask appropriate questions, consider the risks, and seek professional advice where needed.
If you have a medical concern or emergency, you should contact an appropriate healthcare professional or emergency service.
12. Membership tiers, payments and minimum term
Aesthetic Pin membership tiers are provided on a minimum 12-month term unless we expressly agree otherwise in writing.
By purchasing, applying for or accepting a paid membership tier, you agree to pay all fees due for the full 12-month membership term. This applies whether membership fees are paid upfront, monthly, by instalments or by any other payment arrangement we agree with you.
Unless stated otherwise at the point of purchase, membership renews for a further membership term at the end of the current term. We may contact you before renewal where appropriate, but you remain responsible for managing your membership, payment details and cancellation requests.
If you do not wish your membership to renew, you must give us written notice before the renewal date. Unless a different notice period is stated at the point of purchase or agreed in writing, cancellation notice must be received at least 30 days before the renewal date.
Cancellation notice should be sent to info@aestheticpin.co.uk. We may ask you to confirm account details so that we can identify the correct membership.
Membership fees, listing fees, upgrade fees and any other charges will be shown on the website or provided to you before purchase where applicable.
You agree to provide accurate payment and billing information and to keep your payment details up to date. Payments may be processed by a third-party payment provider.
If your membership is paid monthly or by instalments, this does not reduce the minimum 12-month commitment. You remain responsible for paying the full amount due for the full 12-month term.
If a payment fails, is reversed, is cancelled, or is not paid by the due date, we may contact you to request payment. We may also suspend, restrict, hide or remove your membership access, account features, profile, listing or verification-style status until payment is brought up to date.
We may continue to chase unpaid membership fees, listing fees, renewal fees, instalments or other amounts owed to us. Where permitted by law, we may charge interest, late payment charges, debt recovery costs and reasonable administrative costs on overdue amounts.
For business users, we may charge statutory interest and fixed recovery costs on overdue commercial debts in accordance with the Late Payment of Commercial Debts legislation, unless a different lawful rate or remedy has been agreed in writing.
We may refer overdue accounts to a debt collection agency, solicitor or other recovery provider where payment remains outstanding. You may be responsible for reasonable costs we incur in recovering unpaid amounts, where permitted by law.
We may change our prices, membership options, listing options or service features from time to time. Any changes will not affect payments already due for an existing membership term unless stated otherwise or agreed with you.
13. Cancellations and refunds
Aesthetic Pin membership tiers are provided on a minimum 12-month term. Once your membership, application review, listing setup, verification-style review, account setup or service delivery has begun, fees are non-refundable to the fullest extent permitted by law.
Unless we expressly agree otherwise in writing, we do not provide refunds for membership fees, application fees, listing fees, verification-style review fees, upgrade fees, renewal fees, instalments or other paid services.
This includes, but is not limited to, situations where you change your mind, no longer require the membership, do not use the website, do not complete your profile, do not upload required documents, fail to keep information up to date, are rejected following review, have a listing removed or suspended, or choose to stop using the platform before the end of the 12-month term.
If your membership is paid monthly or by instalments, cancellation of your account, listing or payment method does not cancel the remaining balance due for the 12-month term. Any unpaid amounts for the remainder of the minimum term will remain payable.
Cancelling a payment instruction, direct debit, card authority, PayPal agreement or other payment method does not by itself cancel your membership, account, listing, renewal or payment obligation. You must contact us in writing if you wish to request cancellation or prevent renewal.
We may cancel, suspend, restrict or remove a membership, account, listing, profile or verification-style status if these terms are breached, if payment is overdue, if required information is missing or out of date, or if we reasonably consider it necessary to protect the platform, users, members, the public or our business.
No refund will be due where we suspend, restrict, remove or terminate access because of a breach of these terms, non-payment, inaccurate information, misleading information, expired documents, missing evidence, misuse of the website or conduct that we reasonably consider harmful to the platform.
Nothing in these terms limits any rights you may have under applicable consumer protection law where those rights cannot legally be excluded. If you are acting as a consumer and have a statutory right to cancel, we will honour that right where it applies.
Where a renewal has already taken effect because cancellation notice was not received in time, the renewed membership term and any renewal fees may remain payable unless we agree otherwise in writing or the law requires otherwise.
14. Consumer and business users
Some users of the website may be consumers, while others may be businesses, practitioners, clinics, companies, sole traders, partnerships or professional users.
Nothing in these terms is intended to remove or limit any rights you have under consumer protection law where those rights apply.
If you use the website or purchase services on behalf of a business, clinic, company, partnership, employer or organisation, you confirm that you have authority to do so.
Aesthetic Pin memberships and listings are primarily intended for practitioners, clinics, providers, businesses, sole traders, partnerships, companies and other professional or commercial users. If you purchase or apply for a membership, listing or related service for professional, trade or business purposes, you will usually be treated as a business user.
15. Third-party links and services
The website may include links to third-party websites, services, profiles, payment providers, social media pages, practitioner websites, clinic websites or other external resources.
Third-party links are provided for convenience only. We do not control third-party websites or services and are not responsible for their content, accuracy, availability, security, privacy practices or terms.
If you visit a third-party website or use a third-party service, you do so at your own risk and should review that third party’s own terms and privacy information.
16. Intellectual property
Unless otherwise stated, all intellectual property rights in the website, branding, design, layout, text, graphics, logos, icons, software, databases, structure and other materials belong to Aesthetic Pin or our licensors.
You may view, download or print pages from the website for your own personal or internal business use, provided you do not remove any copyright or ownership notices.
You must not copy, reproduce, modify, republish, upload, sell, rent, licence, distribute, scrape, commercially exploit or create derivative works from our website content without our prior written permission, except where permitted by law.
17. Rights in content you submit
You retain ownership of the content you submit to the website, such as profile text, business information, documents, images, listing content or other user-submitted material.
By submitting content to us, you grant Aesthetic Pin a non-exclusive, worldwide, royalty-free licence to use, store, review, copy, display, publish, edit, format and process that content as necessary to operate the website, assess applications, manage memberships, display listings, provide services, protect the platform and comply with our legal obligations.
This licence continues for as long as needed for the purposes for which the content was submitted, including any reasonable backup, record keeping, audit, dispute, legal or platform integrity purposes.
18. Availability of the website
We aim to keep the website available and working properly, but we do not guarantee that the website, accounts, listings, forms, directories, payment systems or other features will always be available, uninterrupted, secure or error-free.
We may suspend, withdraw, restrict, update or change all or part of the website at any time for maintenance, security, technical, legal, business or operational reasons.
We are not responsible for any loss or inconvenience caused by website downtime, technical issues, data connection problems, third-party service issues or matters outside our reasonable control.
19. Limitation of liability
Nothing in these terms excludes or limits liability where it would be unlawful to do so. This includes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded or limited by law.
Subject to the paragraph above, we are not responsible for:
- losses caused by inaccurate, incomplete or outdated user-submitted information;
- decisions made by users based on website content, listings or profiles;
- the acts, omissions, services, treatments, advice or conduct of practitioners, clinics, providers or third parties;
- loss of profit, revenue, business, goodwill, opportunity, data or reputation;
- indirect or consequential loss;
- loss caused by website downtime, cyber incidents, technical faults or third-party service failures, except where we are legally responsible;
- content, services or websites provided by third parties.
If you are a business user, our total liability to you for any claim connected with the website or services will be limited to the amount you paid to us for the relevant service in the 12 months before the claim arose, unless a different limit is stated in separate written terms.
If you are a consumer, your statutory rights are not affected.
20. Indemnity
If you use the website as a business user, practitioner, clinic, provider, member or applicant, you agree to indemnify Aesthetic Pin against reasonable losses, costs, claims, damages, liabilities and expenses arising from your breach of these terms, your misuse of the website, your submitted content, your listing information, your services, or your infringement of another person’s rights.
21. Privacy and cookies
We process personal data in accordance with our Privacy Policy, which explains what personal data we collect, how we use it, who we share it with, how long we keep it and what rights you have.
We also use cookies and similar technologies. More information will be provided in our separate Cookie Policy.
You should read our Privacy Policy and Cookie Policy alongside these terms.
22. Changes to these terms
We may update these terms from time to time to reflect changes in our website, services, memberships, listings, payment arrangements, legal obligations or business practices.
The latest version will be published on this website. Where changes are significant, we may take reasonable steps to bring them to your attention.
If you continue to use the website after the updated terms take effect, you will be treated as having accepted the updated terms.
23. Complaints, reports and platform concerns
We may allow users, members, clients, practitioners, clinics, providers or third parties to report concerns about listings, profiles, member conduct, uploaded content, treatment claims, advertising, documents, professional status, account misuse or other activity connected with the Aesthetic Pin platform.
Reports or complaints should be made in good faith and should include enough information for us to understand the concern. We may ask for evidence, supporting documents, screenshots, correspondence, appointment details, public links or other relevant information where we reasonably consider this necessary to review the issue.
Aesthetic Pin is not a regulator, court, ombudsman, clinical complaints body, insurer, professional disciplinary body or law enforcement agency. We are not required to investigate every complaint in full, reach a formal decision, mediate disputes, determine clinical negligence, assess treatment outcomes or resolve private disputes between users, clients, practitioners, clinics or third parties.
However, where we reasonably believe a concern may affect user safety, platform integrity, public trust, professional conduct, advertising compliance, membership eligibility, verification-style status, listing accuracy or compliance with these terms, we may review the issue and take action we consider appropriate.
Action may include requesting further information, asking a member to update or remove content, hiding or suspending a listing, restricting account access, removing verification-style status, suspending or terminating membership, refusing future applications, preserving evidence, reporting unlawful activity or taking legal action where necessary.
False, malicious, abusive, misleading or bad-faith complaints or reports may result in account restrictions, suspension, removal from the platform or refusal of future access. We may also take action where the complaints or reporting process is used to harass, intimidate, damage or unfairly target another person, practitioner, clinic, business or organisation.
24. Breach of these terms, policies and Community Standards
By creating an account, applying for membership, submitting a listing, uploading content, using member features or interacting with Aesthetic Pin, you agree to follow these Website Terms and Conditions, our Community Standards, our Privacy Policy and any other policies, rules or guidance we publish that apply to your use of the platform.
Our Community Standards are provided in a separate document and form part of the rules that apply to your use of Aesthetic Pin. They explain the behaviour, conduct and content expectations that apply to members, applicants, practitioners, clinics, providers and users of the platform.
If we believe that you have breached these terms, our Community Standards, our policies, or any rules that apply to use of the Aesthetic Pin platform, we may take appropriate action. This may include issuing a warning, requesting changes to your content, removing content, hiding or suspending your listing, restricting account access, suspending or ending your membership, closing your account, removing verification-style status, refusing future applications, reporting unlawful activity, or taking legal action where necessary.
We may also take action where we reasonably believe this is necessary to protect users, applicants, members, the public, our website, our business, our legal position, or the integrity, safety, reputation or trustworthiness of the Aesthetic Pin platform.
If your membership, account, profile, listing or verification-style status is suspended, restricted, terminated or closed before the end of the 12-month minimum term because of a breach of these terms, our Community Standards, our policies, non-payment, inaccurate information, misleading information, expired documents, missing evidence, misuse of the website, or conduct that we reasonably consider harmful to the platform, you remain liable for payment of the full 12-month membership fee, including any unpaid instalments, unless we expressly agree otherwise in writing or the law requires otherwise.
Suspension, restriction, termination or closure of your membership, account, profile, listing or verification-style status does not pause, cancel, reduce or extend the 12-month minimum term, and it does not remove your responsibility to pay any membership fees, instalments or other amounts due.
No refund will be due where we suspend, restrict, terminate or close your membership, account, profile, listing or verification-style status because you have breached these terms, our Community Standards, our policies, or any rules that apply to use of the Aesthetic Pin platform, to the fullest extent permitted by law.
25. Transfer of rights and obligations
We may transfer our rights and obligations under these terms to another organisation if this is reasonably necessary as part of a business transfer, restructuring, merger, sale, acquisition or operational change.
You may not transfer your rights or obligations under these terms to another person without our prior written consent.
Memberships, accounts, listings, profile access and verification-style statuses are non-transferable unless we expressly agree otherwise in writing. A change of practitioner, business owner, clinic operator, legal entity, trading name, employment arrangement or business structure may require a new application, updated evidence, further review or a new membership.
26. If part of these terms is invalid
If any part of these terms is found to be invalid, unlawful or unenforceable, the remaining parts will continue to apply.
27. No waiver
If we do not enforce part of these terms immediately, this does not mean we have waived our right to enforce them later.
28. Force majeure
We will not be responsible for any failure or delay in performing our obligations under these terms where that failure or delay is caused by events outside our reasonable control.
Events outside our reasonable control may include, but are not limited to, acts of God, fire, flood, storm, extreme weather, epidemic, pandemic, war, terrorism, civil unrest, industrial disputes, strikes, failure of utilities, power outages, internet or telecommunications failures, cyber incidents, third-party service failures, hosting failures, payment provider issues, changes in law or regulation, government action, or any other event that we could not reasonably prevent or control.
Where an event outside our reasonable control affects our ability to provide the website, memberships, listings, account access, application reviews, verification-style processes or other services, we will take reasonable steps to reduce the impact where practical.
We will not be liable for any loss, delay, interruption, non-performance or failure to provide services caused by an event outside our reasonable control.
29. Governing law and jurisdiction
These terms are governed by the laws of England and Wales.
If you are a business user, the courts of England and Wales will have exclusive jurisdiction over any dispute arising from or connected with these terms, the website or our services.
If you are a consumer, you may have the right to bring proceedings in another part of the United Kingdom depending on where you live.
